Overview:

If you are a refugee, you must apply for permanent residency status 1 year after you are admitted to the United States as a refugee.

If you are an asylee, you may apply for permanent residency 1 year after you are granted asylum.

Eligibility for Refugee:

  • You must be physically present in the United States for at least 1 year after being admitted as a refugee.
  • You are admissible to the United States as an immigrant.
  • Your refugee status has not been terminated.

Eligibility for Asylee:

  • Physically present in the United States for at least 1 year after being granted asylum.
  • Continue to be a refugee or the spouse or child of a refugee.
  • Are not firmly resettled in any foreign country.
  • Are admissible to the United States as an immigrant.

Obtaining a Green Card through Adjustment of Status

  • Attorney appearance at any USCIS interview(s).
  • Follow up on case status with USCIS.
  • Guarantee of approval by the U.S. government. Outcomes depend on your situation and cannot be guaranteed.
